HuttoParke Real Estate Fraud
In Texas, a seller of real estate is under a duty to disclose material facts that would not be discoverable by the exercise of ordinary care and diligence on the part of the purchaser. The seller or builder may not make false representations, including purposely omitting material information, to induce a buyer to purchase their home. If a seller or builder makes false representations, they may be subject to civil liability for real estate fraud.
If a false representation is made to induce a consumer to enter into a contract to purchase real estate, and the consumer relied upon that false representation or promise, then the seller or builder may be guilty of statutory fraud. Real estate fraud in Texas is governed by the Texas Business and Commerce Code § 27.01 et seq. If the seller or builder committed statutory fraud, the homebuyer may recover monetary damages including actual damages, exemplary damages, equitable remedies, attorney fees, expert witness fees and costs.
Currently, our lawfirm is prosecuting cases against Lennar Homes on behalf of HuttoParke residents. We are alleging that Lennar is guilty of statutory fraud by not disclosing to its consumers and homebuyers that the soil in HuttoParke once contained elevated levels of arsenic in addition to being highly expansive.
